When a City of Springfield, MA unit member was terminated for reasons UPSEU believed to be a violation of the CBA, UPSEU immediately grieved the issue, took the matter to arbitration and won full reinstatement for the employee.
The employer sought to vacate the decision of the arbitrator in Superior Court. UPSEU’s lawyers fought the city’s decision and we were again successful in confirming the arbitration decision. But the city appealed the State Superior Court decision to the Appellate Court of Massachusetts.
UPSEU’s attorneys again fought the city’s appeal and were successful again in the fight. City of Springfield lost at the Appellate Court with the court agreeing with UPSEU.
“UPSEU’s attorney John Connor of Connor, Morneau and Olin, LLP did a terrific job throughout the process and we couldn’t be happier with the outcome on behalf of our member,” stated UPSEU Labor Relations Representative Roger Stolen.
It is unclear if the City will file yet another appeal. “UPSEU’s member has a significant sum owed in full pay and benefits and he eagerly awaits the opportunity to return to work,” Stolen continued.
